1. GENERAL
1.1. The owner of the Freetime Hobby online store (hereinafter referred to as the Online Store) is Freetime Hobby OÜ (registration code 14952402), located in Tallinn.
1.2. These terms of use regulate the legal relationships arising between Freetime Hobby OÜ (Seller) and the person who made the purchase (Buyer) when buying and selling in the Online Store.
1.3. In addition to these terms, the laws of the Republic of Estonia regulate the legal relationships arising from the distribution of products through the online store.
1.4. The Seller may change the terms of use of the online store and the prices of products and services. Changes will be notified in the online store environment. The terms and conditions and prices valid at the time of the transaction are applied to the transaction.
1.5. The selection of products, prices and discounts may differ from the selection of products, prices and discounts in the Seller's retail stores.
1.6 The color of the product image on the computer screen may differ slightly from reality.
2. PRICE
2.1. Information about the product is provided in the Online Store directly next to the product and is exclusive of VAT.
2.2. The prices of the products are indicated in the Online Store next to the products. The price is added to the price for the delivery of the product, unless otherwise stated when paying for the product. The delivery fee depends on the Buyer's location and the method of delivery. The delivery fee is displayed to the Buyer when placing the order.
2.3. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer if the price of the goods in the Online Store is marked significantly below the market price of the goods due to a mistake.
3. PLACEMENT OF AN ORDER
3.1. To order the goods, the desired products must be added to the shopping cart. To place the order, the required data fields must be filled in and the appropriate method of delivery of the products must be selected.
3.2. In the shopping cart, it is possible to change the products and quantities and remove products from the shopping cart until the product is paid for.
3.3. When placing an order, the final price will be displayed on the screen, which can be paid using a bank link or other payment solution.
3.4. The contract comes into force upon receipt of the amount due to the Online Store's current account.
3.5. The Seller will send a notification of order confirmation to the Buyer's e-mail address. If the message is not found in the mailbox, please check whether the message has accidentally ended up in the spam folder.
3.6. The Seller has the right to withdraw from the contract if the ordered goods cannot be delivered due to the goods being out of stock or for another reason. The Seller will notify the Buyer of this as soon as possible and will refund all payments received for the ordered goods (including the costs of delivering the goods) immediately, but no later than within 2 working days of sending the notification.
4. PAYMENT
4.1. The Buyer pays 100% in advance for purchases made in the online store.
4.2. Orders can be paid for using Estonian bank links Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay and Visa and Mastercard card payments.
4.3. Orders are paid in euros.
4.4. When paying with a bank link, be sure to click the "Return to merchant" button on the bank page.
4.5. Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Montonio Finance OÜ. The Seller does not have access to the customer's bank and credit card details. The Agreement enters into force upon receipt of the amount due to be paid to the Online Store's bank account.
The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.
5. DELIVERY
5.1. The Online Store delivers products within Estonia.
5.2. The products are delivered in the manner selected by the Buyer in the Online Store. The delivery partners of the online store are Omniva, Itella and Unisend.
5.3. The Buyer bears the shipping costs of the goods and the corresponding price information is displayed next to the shipping method.
5.4. The Seller ships orders on all working days, but no later than five working days after confirming the order. In exceptional cases, the Seller has the right to deliver the goods within up to 45 calendar days. The latter includes special orders.
6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE OF PRODUCTS
6.1. The Buyer has the right to withdraw from the transaction within 14 calendar days from the receipt of the goods by submitting a written statement of withdrawal from the purchase of the goods to the Seller, which includes the following information:
- First and last name
- Contact phone number
- E-mail address
- Address
- Bank account details
- Date of order placement
- Date of receipt of the goods
- Name of the goods to be returned
- Goods serial number
- Purchase invoice number of the goods
- Reason for return
6.2. The application for withdrawal from the purchase of the goods must be sent to the e-mail address info@freetimehobby.com or to the address Lõõtsa 2, Tallinn no later than 14 calendar days from the receipt of the goods. The Seller confirms receipt of the application for withdrawal by sending a notification to the Buyer.
6.3. The returned product must include all purchase documentation. The labels on the goods and items installed to protect the condition of the goods (e.g. protective films, moisture collectors, plastic wraps, etc.) that do not prevent the goods from being tried on and examined must not be removed when returning the goods.
6.4. To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the same way as it is allowed to try the goods in a physical store. If the goods have been used for any purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Seller has the right to reduce the amount to be refunded in accordance with the decrease in the value of the goods or to refuse to reimburse the cost of the goods.
6.5. The return conditions apply to standard-sized products. Special orders and products customized to special requests are not subject to return.
6.6. The Buyer can exchange the ordered product within 14 calendar days of receipt if the size of the ordered product is unsuitable. The conditions 6.1-6.5 apply to the return of a product of an unsuitable size.
6.7. If the product returned to the Seller cannot be replaced due to the lack of the desired size by the Buyer, the Seller will contact the Buyer to offer a solution.
6.8. The Buyer is obliged to return the product subject to return within 14 calendar days from the date of submission of the withdrawal form.
6.9. The Seller does not assume responsibility for the product until the returned product is received. The return and/or exchange of the product is free of charge, except for the return shipping costs, which are borne by the Buyer. If the Buyer has been handed over a defective product, the costs related to the return shall be borne by the Seller.
6.10. Upon receipt of the returned product, the Seller shall immediately refund to the Buyer, but no later than 14 days after receipt of the withdrawal form, all fees received from the Buyer under the contract, including shipping costs. If the Buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Seller is not required to refund the Buyer any costs exceeding the costs associated with the standard delivery method.
6.11. The Seller shall refund the fees received immediately upon receipt of the returned goods or on the basis of the submitted proof of return of the goods (parcel code).
6.12. The Seller has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer if the price of the goods in the Online Store has been indicated significantly below the market price of the goods due to an error.
7. RIGHT TO MAKE A CLAIM
7.1. The Seller is liable for any non-conformity or defect of the goods sold to the Buyer that already existed at the time of delivery and that becomes apparent within two years from the delivery of the goods to the Buyer. During the first one year from the delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery. The Seller is obliged to rebut this presumption. The Seller is not liable for defects that have arisen after the goods have been delivered to the Buyer.
7.2. If non-conformity or defects of the product are discovered, the Buyer undertakes to notify the Seller immediately, but no later than 2 months after learning about the non-conformity, by sending the relevant information to the e-mail address info@freetimehobby.com or in writing to the address Lõõtsa 2, Tallinn.
7.3. In the event of non-conformity or deficiency of the product, the Buyer has the right to demand that the product be repaired or replaced with a product that complies with the requirements and is free from defects or to return the product at the Seller's expense.
7.4. The Buyer has the right to demand a reduction in the purchase price of the product or termination of the contract and the recovery of the amounts paid for the product if:
- The Seller is unable to repair or replace the product or
- The repair or replacement of the product fails or
- The Seller has not eliminated the defect in the product within a reasonable time
7.5. In the event of a return of a non-conformity product, the Buyer will be reimbursed the amount paid for the product, including the cost of transportation, to the bank account indicated by the Buyer no later than within 14 days. The Seller has the right to delay the refund of the paid amounts until the Buyer has returned the product in his possession.
7.6. The Seller shall bear the costs related to the repair or replacement of the product within the first six months from the transfer of the product to the Buyer. During the following 1 year, the Seller shall bear the corresponding costs only if the claim is justified. The Seller shall not compensate the Buyer for the costs incurred in the event of non-compliance with the requirements or defects of the product and shall not be liable for them if:
- The value of the product has decreased/the product has been damaged due to the fault of the Buyer;
- The defects have arisen due to the use of the product for purposes other than its intended purpose, including as a result of failure to follow the maintenance instructions;
- The value of the product has decreased due to natural wear and tear during normal use;
- There is no copy of the document proving the purchase.
7.7. In the event that disagreements have arisen between the Buyer and the Seller regarding the defects of the product, the Buyer has the right to file a complaint with the Seller, indicating in the complaint submitted in writing or in a form that allows for written reproduction his name and contact details, the date of the complaint, the defect in the product and his proposed solution. The Seller shall respond to the Buyer's complaint in writing or in a form that allows for written reproduction within 14 calendar days. If the Buyer has any complaints regarding the Online Store, they must be sent to the e-mail address info@freetimehobby.com.
7.8. If the Buyer and the Seller do not reach an agreement on the dispute, the Buyer has the right to turn to the Consumer Disputes Committee operating at the Estonian Consumer Protection Board for out-of-court settlement of the dispute. The procedural conditions can be viewed and an application submitted here (https://www.ttja.ee/eraklient/tarbija-oigused/tarbija-oigused-ja-kohustused/kaebuse-esitamine). The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the Seller. The review of the Buyer's complaint by the Committee is free of charge. The resolution of disputes at the Estonian Consumer Protection Board in Estonia is based on the laws of the Republic of Estonia. 7.9. If the parties disagree with the decision of the Commission, they have the right to appeal to the county court of the Buyer's location.
8. PROCESSING OF PERSONAL DATA
8.1. The controller of personal data is Freetime Hobby OÜ (registration code [company registration code]), located at Lõõtsa 2, Tallinn.
8.2. The processing of personal data complies with Estonian and European Union legislation.
8.3. The controller collects the following personal data: name, telephone number, address, e-mail address, bank details. The data is used only to process the order and send the goods to the Buyer. The Seller transfers personal data to companies providing transport services for the purpose of delivering goods.
8.4. Personal data transferred to the Controller is protected and treated as confidential information. Data communication between the customer and banks is encrypted. The Controller does not have access to the customer's confidential bank and payment card details. The Controller does not disclose the data that has become known to him to third parties.
8.5. The Controller may send newsletters, including satisfaction surveys and offers to the Buyer's e-mail address only if the Buyer has given prior consent to this.
8.6. The Buyer has the right to file a complaint with the Data Protection Inspectorate or a court if he finds that his rights have been violated in the processing of personal data. Contact details of the Estonian Data Protection Authority (AKI) can be found on the AKI website at www.aki.ee.
